TERMS AND CONDITIONS

1.1 Introduction

These Terms and Conditions (“Terms”) govern the rights, responsibilities, and obligations of members and prospective members of the Telugu Motion Pictures and Drivers Union (“the Union”). By applying for or maintaining membership in the Union, you agree to abide by these Terms.

1.2 Membership

  • Eligibility : Membership is open to professionals actively involved in the Telugu film industry, subject to the Union’s membership criteria.

  • Approval : The Union reserves the right to approve, reject, or revoke membership based on its internal guidelines and regulations.
  • Membership Renewal : Membership must be renewed according to the Union’s policies, including timely payment of fees. Failure to renew may result in suspension or termination of membership.

1.3 Fees, Payments, and Call Sheets

  • Membership Fees : Members are required to pay fees or dues as prescribed by the Union. These fees may be updated periodically, and members will be notified of any changes.
  • Call Sheet Usage :
    • The Union may issue or maintain call sheets (including timing and amount details) for scheduling and payment purposes.
    • The attached call sheet rates (or any updated versions) serve as a guideline for members regarding remuneration, timing, and shift details.
    • Any disputes or clarifications regarding call sheet amounts or working hours should be addressed with the Union’s designated officials.
  • Refunds : Refunds for membership fees or other payments (if applicable) will be handled on a case-by-case basis as per the Union’s policies.
  • Late Payments : Late or missed payments may lead to suspension of membership privileges until all outstanding dues are cleared.

1.4 Responsibilities and Code of Conduct

  • Professional Conduct : Members shall conduct themselves in a manner that upholds the integrity and reputation of the Union and the Telugu film industry.
  • Compliance : Members agree to comply with all applicable laws, regulations, and Union policies, including rules set forth by the Film Federation and any local film bodies.
  • Respect and Non-Discrimination : Members shall maintain respectful behavior toward fellow members and shall not engage in harassment or discrimination based on race, religion, gender, or any other protected characteristic.
  • Use of Union Resources : Union resources, such as welfare initiatives, are for the exclusive benefit of its members. Any misuse of these resources may result in disciplinary action.

1.5 Welfare Initiatives

  • Retirement Fund : The Union maintains a dedicated fund to support members during retirement, subject to eligibility criteria.
  • Membership Cancellation Fund : A fund to provide limited financial assistance in the event of unforeseen circumstances that necessitate membership cancellation.
  • Death Benefit Fund : In the event of a member’s passing, the Union provides financial assistance to support the family, subject to policy updates.
  • Educational Support : The Union offers scholarships for members' children who achieve outstanding academic performance in their 10th-grade exams.
  • Modifications : The Union reserves the right to modify or discontinue any welfare initiative. Members will be notified of significant changes in advance.

1.6 Governance and Elections

  • Leadership : The Union is led by elected office-bearers, including a President, General Secretary, and Cashier.
  • Election Cycle : Elections are held every two years, ensuring leadership remains responsive to member needs.
  • Decision-Making : The elected body may form committees or sub committees to address specific issues, including disputes, financial management, and welfare initiatives.

1.7 Dispute Resolution

  • Internal Resolution : Members are encouraged to first seek resolution of any disputes through dialogue with Union officials or designated committees.
  • Arbitration : If an internal resolution is not possible, the matter may be referred to an arbitration panel formed by the Union, whose decision shall be binding unless otherwise required by law.
  • Legal Recourse : In cases where arbitration fails or is deemed inappropriate, disputes may be escalated to the relevant courts under applicable laws.

1.8 Limitation of Liability

  • No Guarantees : While the Union endeavors to provide accurate information and effective representation, it does not guarantee specific outcomes for members.
  • Welfare Initiatives: : The Union shall not be held liable for any shortfall in funds or inability to provide welfare benefits due to circumstances beyond its control.
  • Indirect Damages : The Union is not responsible for indirect, incidental, or consequential damages arising from membership or use of Union services.

1.9 Amendments to the Terms

The Union may amend these Terms periodically to reflect changes in policies, legal requirements, or operational needs. Members will be notified of significant changes through official communication channels, and continued membership constitutes acceptance of the revised Terms.
